Agreement to these Terms
By downloading or using TinyFrames, you agree to these Terms of Use. If you do not agree, please do not use the app. These terms govern your use of the TinyFrames iOS application.
1. Acceptance of Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and TinyFrames ("we", "us", or "our") governing your access to and use of the TinyFrames mobile application ("App"). By installing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. License to Use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any iOS device that you own or control, solely for your personal, non-commercial purposes, subject to these Terms.
You may not:
- Copy, modify, or distribute the App or any part of it.
- Reverse engineer, decompile, or attempt to extract the source code.
- Rent, lease, or sublicense the App.
- Use the App for any unlawful purpose or in violation of any regulations.
- Remove, alter, or obscure any proprietary notices within the App.
3. In-App Purchases
TinyFrames offers an optional one-time in-app purchase called "TinyFrames Pro" that unlocks additional export features (PDF export, JPEG saving, and video slideshow generation).
- Non-refundable: All purchases are processed by Apple and are subject to Apple's refund policies. We do not issue refunds directly. For refund requests, contact Apple Support.
- One-time purchase: TinyFrames Pro is a non-consumable purchase. Once purchased, it is available on all your devices signed in to the same Apple ID.
- Restore Purchases: You can restore a previous purchase at any time using the "Restore Purchases" option in Settings, at no additional charge.
- Pricing: Prices are displayed in your local currency as determined by Apple's App Store pricing tiers and may vary by region.
4. Your Content
The photos you use within TinyFrames ("Your Content") remain entirely yours. We claim no ownership over any photos you add to the App. Your Content is stored locally on your device and is never uploaded to our servers.
By using the App, you represent and warrant that:
- You own or have the necessary rights and permissions to use the photos you add.
- Your use of photos within the App does not infringe any third party's intellectual property, privacy, or other rights.
- You will not use photos of other individuals without their consent, particularly minors.
5. Template Content
All template images, illustrations, and graphic assets provided within the App ("Template Content") are owned by TinyFrames or its licensors and are protected by copyright law. The Template Content is licensed to you solely for use within the App to create personal albums.
You may not:
- Extract, redistribute, or sell Template Content as standalone assets.
- Use Template Content for commercial purposes outside of the App.
- Claim ownership of any Template Content.
Albums you create and export using the App — including the Template Content as composed into your albums — may be used for personal and non-commercial purposes, such as printing for personal use or sharing with family and friends.
6. Acceptable Use
You agree not to use the App to create, store, or export content that:
- Is illegal, harmful, threatening, abusive, or harassing.
- Infringes the intellectual property, privacy, or other rights of any person.
- Contains sexually explicit or obscene material, especially involving minors.
- Violates any applicable local, national, or international law or regulation.
7. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in our Privacy Policy.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any defects will be corrected.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TINYFRAMES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid for TinyFrames Pro (if any) in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless TinyFrames and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses arising out of your use of the App, your violation of these Terms, or your infringement of any third party's rights.
11. Updates and Changes
We may update the App from time to time to add features, fix bugs, or improve performance. Some updates may be required to continue using the App. We reserve the right to modify or discontinue the App at any time without notice.
We may also update these Terms from time to time. We will indicate the "Last updated" date at the top of this page. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
12. Termination
These Terms are effective until terminated. Your rights under these Terms will terminate automatically without notice if you fail to comply with any term. Upon termination, you must cease all use of the App and delete it from your device. Sections that by their nature should survive termination (including Sections 8, 9, and 10) shall survive.
13. Apple's Terms
The App is distributed through the Apple App Store. Your use of the App is also subject to Apple's Standard End User License Agreement (EULA). Apple is a third-party beneficiary of these Terms and may enforce them against you as a third-party beneficiary.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through good-faith negotiation in the first instance.
